Who we are

This store is operated by MarcusBR Inc. ("we", "us"), an independent Canadian reseller of genuine bubba products. We purchase our inventory from Randmar, an authorized Canadian distributor of bubba products, and orders are fulfilled from Randmar's Canadian warehouse.

bubba and the bubba logo are trademarks of Newell Brands or its affiliates. We use them to identify the genuine bubba products we sell. This store is operated independently: we are not Newell Brands, and Newell Brands does not operate, sponsor, or manage this store.

By visiting this store or placing an order, you agree to these terms.

Product content and brand materials

Product images, descriptions, and specifications on this store are supplied by or sourced from the manufacturer and from Randmar, our distributor, and are used in our capacity as a reseller of genuine bubba products.

We source and market bubba products under our arrangement with Randmar, the authorized Canadian distributor of bubba products. Under that arrangement, the brand materials on this store are used with Randmar's authorization, and responsibility for our use of those materials rests with Randmar. Any inquiry from a brand owner about materials appearing on this store should be sent to marcus@ibuildapp.ca; it will be reviewed promptly and handled together with Randmar.

Products and responsibility

Everything we sell is a genuine bubba product, manufactured by or for Newell Brands and supplied to us by Randmar. As a reseller, we do not design or manufacture the products.

In addition to any rights you have against us, Canadian and Quebec law gives you warranty rights directly against the manufacturer and the distributor of a product, including the legal warranty of quality under the Civil Code of Quebec and the warranties in the Quebec Consumer Protection Act. Claims about a product defect or product safety can be pursued against the manufacturer or the distributor, and if you contact us we will provide the information you need to do so.

Orders

Placing an order is an offer to buy. We may accept or decline any order, including where an item is out of stock, a price or description was posted in error, or we suspect fraud. If we cancel an order you already paid for, we refund it in full.

Purchases from this store are for personal or household use. We may decline orders that appear to be for commercial resale or export.

Product images are provided by the manufacturer and are as accurate as we can make them. Colours can vary slightly between screens.

Pricing and payment

All prices are in Canadian dollars and do not include applicable taxes, which are calculated at checkout. We may change prices at any time, but changes never affect an order we have already accepted.

Payment is processed by our payment provider. We do not store your full card details.

Stock

Inventory shown on the site reflects live availability at our Canadian fulfillment warehouse. In rare cases an item can sell out between your order and fulfillment. If that happens we contact you and refund in full.

Our platform

This store runs on the Shopify e-commerce platform. Shopify Inc. provides the software only. Your purchase is made directly with MarcusBR Inc., and Shopify is not responsible for any aspect of the sale.

Your account

If you create an account, you are responsible for keeping your password secure and for activity under your account. Tell us right away if you believe someone else has access.

Acceptable use

Do not use this store for anything unlawful, do not attempt to interfere with the site or its security, and do not scrape or copy the site for a competing service.

Limitation of liability

To the fullest extent permitted by law, our liability for any claim relating to an order is limited to the amount you paid for that order. Claims that concern the product itself, including defects in design, materials, or manufacturing, are the responsibility of the manufacturer and the distributor as described under Products and responsibility above. Nothing in these terms limits rights you have under applicable consumer protection law, including the Quebec Consumer Protection Act.

Governing law

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada that apply there.

Changes

We may update these terms. The version posted on this page at the time you order is the version that applies to that order.
